1. Service Description

lumina-runway is an AI-powered video generation platform that allows users to create videos from text prompts or images using Sora 2.0.

Important: lumina-runway is an independent platform and is not affiliated with, endorsed by, or sponsored by OpenAI. We provide a specialized user interface built on Sora 2 to enhance usability.

2. Acceptance of Terms

By creating an account or using lumina-runway, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our service.

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notice. Continued use after changes constitutes acceptance.

3. Payment and Billing (Powered by Creem)

All payments on lumina-runway are processed by Creem, our merchant of record. When you make a purchase:

You will see 'Creem' on your billing statement and email receipts.

Creem is responsible for payment processing, invoicing, tax collection, and refund handling.

lumina-runway is responsible for product delivery, customer support, and service quality.

By purchasing, you agree to Creem's buyer terms available at creem.io/terms.

4. Credits and Subscriptions

Credits are the virtual currency used on lumina-runway to generate videos.

Credit packs are one-time purchases with no expiration date unless stated otherwise.

Subscriptions provide recurring credits on a monthly or yearly basis.

Credits are consumed when you generate a video, based on model, duration, and quality.

Unused credits are non-refundable except as required by law or our Refund Policy.

We reserve the right to change credit pricing or models with notice to existing subscribers.

5. Acceptable Use Policy

You agree to use lumina-runway only for lawful purposes. You must not:

Generate content that is illegal, harmful, threatening, abusive, or defamatory.

Create deepfakes, non-consensual sexual content, or content that violates privacy rights.

Infringe intellectual property rights of others.

Violate any applicable laws or regulations in your jurisdiction.

Attempt to circumvent usage limits, credit systems, or technical protections.

Use the service to compete with lumina-runway or reverse-engineer our technology.

We reserve the right to suspend or terminate accounts that violate these policies.

6. Content and Intellectual Property

You retain ownership of videos you generate, subject to these terms and AI model provider policies.

Commercial Use: Videos generated with paid credits or active subscriptions include commercial usage rights.

Commercial use is available on paid credits only.

We do not claim ownership of your content but require a license to operate and improve the service.

You are responsible for ensuring your generated content complies with applicable laws.

7. AI Model Limitations and Disclaimers

AI-generated content may contain errors, biases, or inaccuracies.

Output quality varies based on prompt complexity, model capabilities, and system load.

We do not guarantee specific results, generation times, or output quality.

AI models may be updated or changed without notice, affecting output consistency.

You are responsible for reviewing generated content before use.

8. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials.

You must provide accurate and complete information when creating your account.

Notify us immediately if you suspect unauthorized access to your account.

You are liable for all activities that occur under your account.

Accounts are for individual use unless explicitly authorized for team or business use.

9. Subscription Management and Cancellation

You may cancel your subscription at any time through your account settings or by contacting support.

Cancellation takes effect at the end of the current billing period.

No partial refunds for unused portions of a billing period unless required by law.

We may pause or suspend service for non-payment or suspected fraud.

Auto-renewal can be disabled at any time before the next billing date.

10. Service Availability and Modifications

We strive for 99.9% uptime but do not guarantee uninterrupted service.

We may temporarily suspend service for maintenance, updates, or technical issues.

We may add, modify, or remove features, models, or pricing with notice.

We are not liable for losses resulting from service interruptions.

11. Termination

We may suspend or terminate your account if:

You violate these Terms of Service or our Acceptable Use Policy.

You engage in fraudulent or abusive behavior.

We are required to do so by law.

We discontinue the service in whole or in part.

Upon termination, your right to use the service ceases immediately. We may delete your data after a reasonable retention period.

12. Dispute Resolution and Refunds

All refund requests are handled by Creem. Contact support@lumina-runway.art for assistance.

We commit to responding to customer inquiries within 3 business days.

If we do not respond, Creem may issue a refund on our behalf to ensure customer satisfaction.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.

We do not guarantee that the service will meet your requirements or be error-free.

Your use of the service is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

lumina-runway shall not be liable for indirect, incidental, special, or consequential damages.

Our total liability is limited to the amount you paid in the last 6 months.

This limitation applies even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow these exclusions, so these limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless lumina-runway, Creem, and our affiliates from:

Any claims arising from your use of the service or generated content.

Your violation of these terms or applicable laws.

Your infringement of third-party rights.

We reserve the right to assume the exclusive defense of any matter subject to indemnification.

16. Governing Law and Jurisdiction

These terms are governed by the laws of the jurisdiction where lumina-runway is established.

Any disputes shall be resolved through amicable negotiations, failing which in courts of competent jurisdiction.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17. General Provisions

These terms constitute the entire agreement between you and lumina-runway.

We may assign these terms to a successor or affiliate in connection with a merger or acquisition.

If any provision is found invalid, the remaining provisions remain in effect.

Failure to enforce any provision does not constitute a waiver.

18. Product-Specific Disclosures

AI Models Used: Sora 2 (OpenAI).

Model Availability: Model availability depends on the provider's status.

Generation Times: Typically 2-5 minutes but may vary based on queue length and complexity.

Output Quality: Results depend on prompt quality, model capabilities, and system conditions.

Credit System: Credits are consumed upon generation initiation, not completion.
